Insurance Mandate​​​

This mandate governs the engagement of the broker for the management and administration of the client's insurance portfolio. The broker assumes all insurance-related tasks on behalf of the client.

The client authorizes and empowers the broker/co-broker to provide ongoing management of the entire insurance portfolio, including pension fund plans and retirement solutions.

Administration: Unless otherwise agreed, correspondence will be directed to the broker's address, applicable for insurance contracts, modifications, declarations, claims documents, premium invoices, etc. The broker forwards original documents to the co-broker, who ensures they reach the client. In special situations or as needed, other arrangements can be made between the parties.
 

The client remains the policyholder and beneficiary of pensions and is also responsible for premium payments. The client signs insurance and pension contracts themselves and receives claim payments and pension benefits from insurers. In special situations, based on need or operational changes, alternative arrangements can be made between the parties.
 

The broker represents the client in all other matters with insurers and foundations. The broker is also authorized to conduct negotiations, access files, manage existing insurance contracts, and, upon agreement with the client, terminate and request new offers for these contracts.

The co-broker commits to the following tasks:

  • Managing and reviewing existing contracts, as well as assessing needs and cost efficiency.

  • Providing recommendations to the client as needed.

  • Supporting the client with claims as necessary.

  • Informing the client about updates and developments in the insurance and pension sectors.

  • Utilizing special insurance framework agreements negotiated by Baumassurance AG for its clients.

  • Conducting tenders and market comparisons for the client.
     

Compensation of the Broker / Co-Broker:

  • Through the mandate, the broker receives a market-standard brokerage fee from insurers. No additional costs arise for the client within the usual scope of support obligations. If the broker is not compensated by the client’s insurer, the client owes the broker a fee based on the consulting effort, as outlined in the terms of the "Fee Agreement."

    The compensation paid by insurers to the broker depends on the premium amount and the insurance sector. The typical average compensation rates per insurance sector are as follows:

    ​Insurance Sectors and Commissions as a Percentage of the Premium (Excluding Stamps and Fees)

    • Accident insurance under UVG: 3–5%

    • Health daily allowance insurance: 7.5%

    • Other accident insurance: 15%

    • Pension funds (cost and risk premiums): 10%

    • Property insurance: 15%

    • Technical insurance: 15%

    • Transport insurance: 15%

    • Liability and other financial insurance: 15%

    • Motor vehicle insurance: 8%

    • Marine / Aviation: 15%

  • One-Time Fees

    • KVG Basic Health Insurance: CHF 70

    • VVG Supplementary Health Insurance: Monthly premium × 12–16 in CHF
       

  • Compensation for the placement of individual life insurance policies, asset investments, and mortgages is detailed in the "Commissions" appendix.

  • The client has the right at any time to request information on the type and amount of compensation the broker receives for each of their insurance contracts. The client generally agrees that the broker may retain compensation from insurers and other providers.

  • Additional consultations and extended services will be provided based on prior agreement with the client and billed in accordance with the provisions of the "Fee Consulting" contract.

Contract Duration:

The broker mandate is a legal agreement governed by Articles 394 ff. of the Swiss Code of Obligations (OR). It begins on the date of signing, is concluded for an indefinite period, and can be terminated by either party at any time under Article 404 of the Swiss Code of Obligations. Termination at an inopportune time remains subject to specific conditions. The broker informs insurers of any mandate changes accordingly.


Data Protection:
The broker commits to processing the client’s personal data in compliance with the requirements of the Swiss Data Protection Act (DSG) (see also the information provided below in accordance with Article 45 of the Insurance Supervision Act).

The client agrees that, as part of the mandate, the broker and their co-brokers may share the client’s data with third parties as necessary for the purpose of fulfilling the mandate and processing data.

Contractual Relationships

  • As an independent and autonomous insurance intermediary, the Broker collaborates with partners across all branches of insurance based on the client’s insurance needs.
    The list of partners is continuously updated on our website at www.baumassurance.ch.
    Cooperation agreements exist with insurance companies, but these agreements do not impose any production or exclusivity obligations on the Broker. The Broker/Co-Broker works on behalf of its clients according to the broker mandate and is compensated by insurance companies with market-standard commissions.

Duty of Care / Liability

  • The Broker and the Co-Broker are liable for any claims arising from errors, negligence, or incorrect information, within the framework of legal provisions. Both the Broker and the Co-Broker have professional liability insurance covering financial damages with a legally prescribed sum insured.

Training and Education

  • The Broker continuously trains its employees, particularly concerning the insurance products of the aforementioned insurance companies.

Data Protection / Confidentiality

  • Personal data is processed by Baumassurance AG or its Co-Brokers only to the extent necessary for the services agreed upon in the broker mandate (data processing purpose). Baumassurance AG and the Co-Broker commit to taking all measures to comply with the relevant legal data protection regulations. Data is treated with absolute confidentiality and is typically stored in electronic and/or paper form.
    The Broker and its Co-Brokers handle client data strictly confidentially in accordance with data protection policies. Please read the data protection policies on our website: www.baumassurance.ch/datenschutz.
    According to the Data Protection Act, you have the right to access your personal data, as well as the right to correct, block, or delete it.

    Data transfers necessary for processing with insurance companies or third parties, as well as the processing of the data itself, are accepted by the client upon signing this form.

Ombudsman Office

  • In case of conflicts, you have the option to contact the Ombudsman Office for Insurance Intermediaries to initiate a mediation process.

    The undersigned confirms having read and understood this legally required information.

This form is an integral part of the broker mandate.
